1. Booking & Confirmation
A booking is considered confirmed only after receipt of the required deposit or full payment. By confirming a booking, the traveler acknowledges and agrees to abide by these Terms & Conditions. Any remaining balance must be paid before the trip departure date, as advised by the tour operator. Failure to complete payment within the specified time may result in cancellation of the booking without refund of any payments made.2. Payment Policy
All payments must be made using the accepted payment methods provided at the time of booking. Any bank charges, transfer fees, or transaction costs are the sole responsibility of the traveler. Prices are based on current costs, exchange rates, and service availability and may be subject to change due to external factors such as government regulations, supplier cost increases, currency fluctuations, or unforeseen circumstances.3. Cancellation, Refund & Early
Return Cancellation and refund eligibility depend on the time of cancellation and the services already booked, confirmed, or used. Any non-refundable costs (including but not limited to permits, accommodations, transportation, or third-party services) will be deducted from any applicable refund. No refund, adjustment, or credit will be provided for unused services resulting from early return, illness, weather conditions, personal reasons, delays, or any circumstances beyond our control. Any additional costs incurred due to early return or changes to travel arrangements are the sole responsibility of the traveler.4. Changes to Itinerary
The tour operator reserves the right to modify or adjust the itinerary at any time due to weather conditions, safety concerns, road or trail conditions, natural disasters, political situations, or other unforeseen circumstances. All such changes will be made in the best interest of traveler safety and overall experience. Changes made for these reasons do not constitute a breach of contract, and no compensation, refunds, or claims will be applicable for itinerary modifications beyond the tour operator’s control.5. Travel Insurance
Comprehensive travel insurance is mandatory for all trekking and adventure trips. Insurance must cover high-altitude trekking, medical treatment, emergency helicopter evacuation, and trip interruption. Travelers are solely responsible for ensuring their insurance is valid, adequate, and active for the entire duration of the trip. The tour operator and its partners accept no responsibility for any costs, losses, or consequences arising from insufficient, invalid, or inadequate insurance coverage.
We strongly recommend purchasing an insurance policy that allows upfront payment with reimbursement later, as this helps ensure faster response and smoother service in case of a medical emergency, avoiding delays caused by approval processes while traveling abroad.6. Health & Fitness
Travelers must ensure they are physically and mentally fit to participate in the trip. Any medical conditions, allergies, medications, or special requirements must be fully disclosed prior to booking. The tour operator reserves the right to refuse, restrict, or terminate participation at any stage of the trip if a traveler’s health condition, fitness level, or behavior is deemed to pose a risk to themselves, other travelers, or staff. In such cases, no refunds, credits, or compensation will be provided, and any additional costs incurred shall be the sole responsibility of the traveler.7. Altitude, Safety & Responsibility
Trekking and adventure travel involve inherent risks, including altitude sickness, rapid weather changes, and challenging terrain. While our guides follow standard safety procedures and act in the best interest of the group, the final responsibility for personal safety lies with the traveler. All safety-related decisions made by guides— including those concerning pace, route changes, rest days, or emergency evacuation—are final and binding. These decisions are made to protect the safety of travelers and staff and do not entitle travelers to refunds, compensation, or claims.8. Flights, Delays, No-Show & Force Majeure
The tour operator and its partners are not responsible for any delays, cancellations, disruptions, or additional expenses caused by international or domestic flight delays, weather conditions, natural disasters, sudden protests, political unrest, strikes, airline schedule changes, government actions, pandemics, or any other force majeure events beyond our control.
If a traveler is unable to join the group tour on the scheduled start date, for any reason, this will be treated as a no-show. In the case of a non-private (group) tour, the itinerary will not be modified or delayed, and no refunds, credits, or compensation will be provided for missed services or unused portions of the trip.
Any alternative arrangements, revised itineraries, or continuation of the trip after a missed start date will be considered a new and private arrangement, subject to availability, and must be paid separately by the traveler directly to the local partners. The original group booking cannot be transferred or adjusted.
All additional costs, including accommodation, transportation, flights, permits, guide services, or other expenses arising from such situations, shall be the sole responsibility of the traveler.9. Accommodation & Facilities
In cities such as Kathmandu and Pokhara, accommodation is provided in 3-star deluxe hotels on a twin-sharing basis, which is the standard pricing basis, with a daily buffet breakfast included. Laundry services are available in city hotels at an additional cost. Private or single rooms can be arranged upon request, subject to availability and an additional single-supplement charge.During the trek, accommodation is arranged in local teahouse lodges and is based on shared rooms, which may be triple, quad, or multiple-bed rooms, especially at higher altitudes and during peak season, due to limited lodge availability. Each trekker is provided a separate bed. Facilities such as Wi-Fi, charging, and hot showers may be available at lower elevations, but are often limited, unreliable, and usually provided at an additional cost. Laundry services are not available during the trek.
As altitude increases, the availability and quality of facilities may decrease due to local conditions and infrastructure limitations. Please note that room-sharing arrangements and facility availability depend on location and season, and no refunds or adjustments are applicable for these conditions.
10. Transportation, Permits & Tour Support Staff
All transportation, required permits, and tour-supporting local staff (including guides, porters, drivers, and assistants) are arranged through our trusted local partner company, Jagadamba Holidays. Transportation services may be provided using the partner’s own vehicles or hired authorized vehicles, and all services are delivered through licensed, experienced, and insured personnel, in accordance with recognized mountain tourism hospitality standards.Travelers are required to respect all staff, comply with local laws, customs, and cultural norms, and behave responsibly toward fellow travelers at all times. Any misconduct, abusive behavior, or failure to follow guide instructions may result in immediate termination of participation without refund or compensation, if deemed necessary for safety, operational, or service-quality reasons.
At the end of the trek, tipping the trekking crew (guides, porters, and support staff) is considered mandatory and customary in mountain tourism hospitality. Tipping is a shared group responsibility and should be provided based on service quality and trip duration, in line with local trekking practices.
11. Personal Belongings & Liability
Travelers are solely responsible for their personal belongings at all times throughout the trip. The tour operator and its partners accept no liability for any loss, damage, delay, or theft of personal items, including but not limited to luggage, valuables, documents, or electronic equipment.
Participation in all activities, including trekking, sightseeing, transportation, and optional activities, is undertaken at the traveler’s own risk. Travelers are responsible for assessing their personal health, fitness, and capability to participate and are strongly advised to obtain comprehensive travel insurance covering medical expenses, evacuation, trip interruption, and personal belongings.12. Age & Participation
Minimum age requirements may apply depending on the specific trip and itinerary. Travelers under 18 years of age must be accompanied by a parent or legal guardian and may be required to provide written consent where applicable.The tour operator reserves the right to adjust, modify, or restrict participation in group arrangements, itineraries, or activities for logistical, operational, health, or safety reasons. Such adjustments shall not be considered a breach of contract and do not entitle travelers to refunds or compensation.
13. Photography, Filming & Marketing
We may use photographs or video footage taken during the trip for promotional and marketing purposes. If any traveler does not wish their images or footage to be used, this must be clearly communicated in writing before the trip begins. If no such notice is received, consent will be assumed.The use of professional filming equipment, video cameras, and drones is regulated by law in Nepal and may require special permits and applicable government fees. Travelers intending to use such equipment must obtain prior approval, secure all required permits, and bear all associated costs. All filming and drone use must comply with local regulations, restricted areas, and guide instructions. Unauthorized use is strictly prohibited, and any consequences arising from such use are the sole responsibility of the traveler.
14. Governing Law & Tour Operator and Partner Responsibility
These Terms & Conditions are governed by the laws of Poland and applicable European Union regulations. Any disputes or claims arising from or related to this agreement shall be subject to the jurisdiction of the competent courts in Poland, unless otherwise required by mandatory law.The tour operator, together with its authorized local partners, is responsible for arranging and coordinating the services included in the tour. All ground operations are carried out by trusted local partners under the tour operator’s supervision. Certain services may be affected by local conditions, availability, weather, safety considerations, or operational limitations.
Any issues, concerns, or service-related matters must be reported immediately during the trip to the tour operator or its authorized local partner to allow reasonable opportunity for resolution. Issues not raised during the trip may be considered accepted, and no claims, refunds, or compensation will be considered after the traveler returns home.
The tour operator reserves the right to make necessary changes to itineraries or services in the interest of safety, operational feasibility, or force majeure, without such changes constituting a breach of contract.
